When you replace a roof, it has to meet building code, and that is a good thing. Code is what keeps a roof from leaking, blowing off, or collapsing, and it is the baseline a legitimate roofer builds to without being asked. This is a plain-language tour of what the code actually requires, so you can read an estimate, ask sharper questions, and tell a thorough roofer from a corner-cutter. Think of it as the map that ties together every roofing decision.
Code is the floor, not the ceiling
First, the frame for everything below. Residential roofing in the United States is governed mostly by the International Residential Code, the IRC, a model code published by the International Code Council and adopted state by state, then amended locally. Florida uses its own heavily amended Florida Building Code. The single most important thing to understand is right there in the code’s own language: it sets the minimum regulations for a safe roof. Code is the floor. A good roofer meets it as a baseline and routinely exceeds it.
Because editions and local amendments vary, the exact rules in your town can differ, so treat what follows as the general shape and confirm specifics with your building department. The section numbers here are from the widely used 2021 edition of the IRC.
You need a permit
Nearly every jurisdiction requires a building permit to tear off and replace a roof. Minor repairs, a few shingles, are usually exempt, but a full replacement is regulated work. The permit is not just red tape: it is what brings the inspections that verify the roof was built right, and it is what protects you at resale and on an insurance claim. No more than two layers of shingles
Code caps a roof at two layers of covering. Under IRC section R908.3, you cannot install a new layer over a roof that already has two, and several other conditions, like a water-soaked or deteriorated existing roof, force a full tear-off too. A sound deck underneath
New roofing has to go over sound sheathing, so rotted or damaged decking must be replaced before anything covers it, under the roof sheathing provisions in IRC section R803. The minimum panel thickness depends on how far apart your rafters are, so there is no single universal number, only a "must be adequate for the span" rule. In Florida, a roof replacement stripped to the deck generally also requires re-nailing the existing sheathing to the current hurricane schedule, commonly ring-shank nails at 6 inches on center. Underlayment, sized to the slope
Every shingle roof needs underlayment over the deck, required under IRC section R905.1.1. The amount depends on the pitch. Steeper roofs get a single layer, but low-slope roofs between 2 in 12 and 4 in 12 require a doubled, overlapping layer for extra protection, and asphalt shingles are not permitted at all below 2 in 12. The flatter the roof, the more waterproofing the code demands, which is exactly why estimates treat low-slope roofs differently. See roof underlayment types.
An ice barrier in cold climates
In regions with a history of ice forming at the eaves, code requires an ice barrier, and this is one of the most important requirements to know if you live in the snow belt. Under IRC section R905.1.2, the barrier, a self-adhering membrane or two cemented layers, must run from the eave to at least 24 inches inside the exterior wall line, reaching over the heated living space where ice dams back water up. Whether it applies is a local, climate-based call, so it is not universal, but where winters are cold it is essential. It is the ice and water shield at work, and it is what stands between an ice dam and your ceiling.
Drip edge at the edges
A metal drip edge is required at both the eaves and the rake edges of a shingle roof, under IRC section R905.2.8.5. This one is worth knowing because it is relatively new: drip edge only became a code requirement in the 2012 edition of the IRC, so homes reroofed before then may not have it at all. It is cheap, it protects the fascia and deck from rot, and it is a common thing for cut-rate roofers to skip. The full story is in what drip edge is and why code requires it.
Flashing at every transition
Code requires flashing wherever the roof meets a wall, changes direction, or is penetrated by a chimney, vent, or skylight, and in the valleys, under IRC section R903.2. It even calls out kick-out flashing, the small piece at the bottom of a roof-to-wall intersection that diverts water away from the wall, whose absence causes a classic hidden leak. Attic ventilation
An enclosed attic has to breathe, and code sets the amount. Under IRC section R806.2, the baseline is 1 square foot of net free ventilating area for every 150 square feet of attic space, which can be relaxed to 1 in 300 when the venting is balanced and, in cold zones, paired with a vapor retarder. Under-ventilate an attic and you cook the shingles and grow moisture problems, which is why this is a code requirement and not an option. See roof ventilation explained.
Wind ratings, and the hurricane zone
Shingles have to be rated for the wind where you live. Under IRC section R905.2.4, asphalt shingles must be tested to a recognized wind standard and matched to the site’s design wind speed, with the highest classes rated to around 150 miles per hour. High-wind and hurricane regions add far stricter rules. In Florida’s High-Velocity Hurricane Zone, Miami-Dade and Broward counties, the code demands a secondary water barrier across the entire deck, enhanced nailing, and products carrying a specific approval, which is why a Miami or Fort Lauderdale roof is built to a different standard than one inland.
Florida also has its 25 percent rule, in the Existing Building Code section 706.1.1, which can require an entire roof section to be brought up to current code when a quarter or more of it is worked on, though a 2022 law exempted roofs permitted on or after March 1, 2009. Inspections close the loop
The permit brings inspections, typically two or three on a reroof: an in-progress or dry-in inspection after the tear-off, to confirm the deck is sound and the underlayment and nailing are right, and a final inspection when the work is done. This is the code catching problems while they are still fixable and, crucially, generating the record that closes the permit out. A roof that is never inspected is a roof nobody verified, which becomes a problem later.
That last point is why a skipped or unclosed inspection turns into an open permit that can stall a home sale years down the road.
Why code compliance protects you
Beyond the roof staying on your house, building to code protects you in three concrete ways:
- Safety. Code is the enforceable minimum for a roof that sheds water and survives wind, which is the entire point.
- Insurance. Unpermitted or non-code roof work can complicate or undermine a claim, and after a loss an insurer may only owe you code-compliant repairs. A properly permitted, inspected roof is a documented one.
- Resale. Unpermitted work and open permits surface during a sale, in the title search or the disclosures, and can stall or shrink a deal.
Meeting code is the baseline, not the sales pitch
When a roofer tells you the work "meets code," that is the floor, not a feature. The roofers worth hiring treat code as the starting point and exceed it where it matters: ice and water shield in the valleys and around penetrations, an upgraded underlayment, balanced ventilation, proper ridge cap. "To code" is what you should expect. "Better than code, and here is where" is what distinguishes a good one.
How to use this
You do not need to memorize section numbers. You need to know that these requirements exist so you can read an estimate and notice what is missing. A thorough estimate names the underlayment, the ice and water shield locations, the drip edge, the flashing, the ventilation, and the decking allowance, because those are the code-driven parts of the job. A one-line "replace roof" estimate hides exactly the items code cares about most. That is the whole argument of what a roofing estimate should include.
